Terms of Service

Welcome to Ainify. By accessing or using the Ainify platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before creating an account or using any features of the platform.

1. Acceptance of Terms

By registering for an account or otherwise accessing the Service, you confirm that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Ainify is an AI twin platform that allows users to:

• Create and train a personalized AI model ("AI Twin") based on their own knowledge, personality, and preferences.
• Share their AI Twin publicly via a unique profile URL (e.g., ainify.me/u/username).
• Embed their AI Twin on external websites using the provided embed script.
• Interact with other users' AI Twins.
• Configure automations triggered by public interactions.
• Manage contacts gathered through public interactions.

Features marked "Under Construction" are experimental and subject to change or removal at any time without notice.

3. User Accounts

3.1 Registration You must provide accurate and complete information when creating an account. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

3.2 Account Termination We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are found to be inactive for an extended period.

4. User-Generated Content & AI Training Data

4.1 Your Content Content you provide to train your AI Twin ("Training Data"), including text, memories, and personal information, remains your responsibility. You grant Ainify a non-exclusive, royalty-free license to use this content solely for the purpose of operating and improving the Service.

4.2 Content Standards You agree not to upload Training Data or configure your AI Twin to produce content that is:

• Illegal, defamatory, or fraudulent
• Harassing, threatening, or abusive toward any individual
• Sexually explicit or involving minors
• Designed to impersonate another person in a harmful or deceptive manner
• In violation of any third party's intellectual property rights

4.3 AI Outputs Responses generated by your AI Twin are based on your Training Data and the underlying AI model. Ainify does not guarantee the accuracy of AI-generated responses and is not liable for any harm arising from them. You are responsible for ensuring your AI Twin does not produce harmful or misleading content.

5. Public Profiles & Embeds 5.1 Public Visibility When you make your profile public, your AI Twin is accessible to anyone, including unauthenticated visitors. You are solely responsible for what your public AI Twin communicates.

5.2 Embeds You may embed your AI Twin on external websites using the Ainify embed script. By doing so, you acknowledge that interactions on those sites are subject to these Terms.

Automations

Automations are features that trigger actions based on public user interactions with your AI Twin. These features are currently under active development. By enabling automations, you take full responsibility for the actions they perform. Ainify is not liable for any unintended outcomes caused by automation configurations.

7. Prohibited Uses

You agree not to:

• Use the Service to scrape, collect, or harvest data from other users without their consent
• Attempt to reverse engineer, decompile, or extract the source code of the Service
• Use the Service to send spam, phishing, or any unsolicited communications
• Interfere with the integrity or performance of the platform
• Circumvent any rate limits, access controls, or security mechanisms

8. Subscription & Payments

Ainify offers both free and paid subscription tiers. By subscribing to a paid plan, you agree to the pricing and billing terms displayed on the Pricing page at the time of purchase. All payments are non-refundable unless otherwise required by applicable law. We reserve the right to modify pricing with reasonable advance notice.

9. Intellectual Property

All trademarks, logos, and service marks of Ainify are the exclusive property of Ian Macalisang. The Ainify platform, its design, and underlying technology are protected by intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property without prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. By using Ainify, you consent to the data practices described therein, including the storage of your training memories in our vector database for AI retrieval purposes.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. Ainify does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated content is not a substitute for professional advice of any kind.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Ainify and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless Ainify and its owner from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes.

15. Governing Law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of the Philippines.
